Terms and conditions of use of the mital.com website

These terms govern access to and use of the mital.com website and of all its content. By browsing the website you declare that you have read and fully accept them. If you do not wish to accept them, please do not use the website.

1. Website owner

Mital Srl
Via Cherso, 21 — 31045 Motta di Livenza (TV), Italy
VAT and tax code 01110170261

2. Nature of the website: a catalogue, not an online shop

This website is informative and presents the Mital catalogue. It is not an online shop: it does not allow products to be purchased, it does not display retail prices, it does not take orders and it handles no payments. Product information does not constitute an offer to the public within the meaning of Article 1336 of the Italian Civil Code, nor a contractual proposal. Every supply is governed by the terms of sale agreed separately between Mital Srl and the customer or dealer.

3. Product information

Mital Srl takes care to ensure that product sheets, dimensions, finishes and materials are accurate, but does not warrant that such information is at all times complete, up to date or free from error. Photographs and three-dimensional models are illustrative: actual finishes may differ owing to screen colour rendering, lighting and manufacturing tolerances. Mital Srl reserves the right to change the range, the technical specifications and the finishes of the products presented at any time and without notice.

4. Intellectual property

All content on this website — texts, photographs, technical drawings, three-dimensional models, videos, graphics, layout, trade marks, logos and trade names — belongs to Mital Srl or to its respective owners and is protected by copyright law (Italian Law 633/1941), trade mark law and the law on industrial designs.

You may only consult the website and reproduce individual pages or items of content for personal use or internal professional use, provided that attributions and distinctive signs are not removed. In particular, without the written authorisation of Mital Srl you may not:

  • reproduce, distribute, publish, communicate to the public or market the content of this website;
  • modify, adapt or create derivative works from the content, the photographs or the three-dimensional models;
  • use Mital trade marks, logos or trade names in a way that creates confusion as to the origin of the products or suggests business relationships that do not exist;
  • systematically extract or re-use substantial parts of the catalogue, including by means of automated data-collection tools.

5. Downloadable material

The catalogues, technical data sheets, CAD files and three-dimensional models made available in the Download area are supplied for information and design purposes only. Designers, dealers and customers may use them to prepare projects and quotations involving Mital products, provided that the identifying details are not altered and that they are not used to make, have made or market competing or imitative products. Any other use requires the written authorisation of Mital Srl.

6. Proper use of the website

You undertake to use this website in compliance with the law and not to engage in activities liable to damage it or impair its operation. In particular, you may not:

  • attempt to access restricted areas, data or systems without authorisation;
  • introduce viruses or malicious code, or take any action capable of overloading the infrastructure;
  • send unlawful, defamatory or offensive content, or unsolicited commercial messages, through the website’s forms;
  • supply false data, or the personal data of third parties without their consent.

Mital Srl reserves the right to suspend access to the website for anyone breaching these terms, without prejudice to any further action to protect its rights.

7. Contact form and newsletter

By completing the contact form or subscribing to the newsletter you declare that the data provided are true and that, where they relate to third parties, you have the necessary authority to provide them. Newsletter subscription is free, optional and may be cancelled at any time. The processing of personal data is described in the privacy notice.

8. Links to third-party websites

This website may contain links to websites operated by third parties. Such links are provided for your convenience: Mital Srl does not control the linked websites and is not responsible for their content, their privacy practices or the products and services offered there. Access to third-party websites is at your own risk.

Linking to mital.com is permitted provided that it does not occur in contexts that harm the website’s reputation, does not suggest business relationships that do not exist and does not use framing techniques that conceal the origin of the content.

9. Availability of the service

Mital Srl endeavours to keep the website accessible and up to date but does not guarantee continuity of service, which may be suspended or restricted for maintenance, updates, technical reasons or events beyond its control, without any liability arising as a result.

10. Limitation of liability

To the extent permitted by law, Mital Srl is not liable for direct or indirect damage arising from access to the website, from being unable to access it, from the use of or reliance on the information published, nor for any damage to your devices caused by malfunctions or by malicious software spread by third parties. Nothing in these terms excludes or limits liability for wilful misconduct or gross negligence, nor the mandatory rights granted to consumers by law.

11. Personal data protection

The processing of personal data collected through this website is described in the privacy notice; the use of cookies is described in the Cookie policy. Both documents form an integral part of these terms.

12. Changes to these terms

Mital Srl may amend these terms at any time, for organisational reasons or to comply with the law. The applicable terms are those published on this page at the time of access; the date below indicates their latest revision. You are invited to review them from time to time.

13. Governing law and jurisdiction

These terms are governed by Italian law. The Court of Treviso has exclusive jurisdiction over any dispute concerning their interpretation or performance. Where you qualify as a consumer under Italian Legislative Decree 206/2005, the jurisdiction of the court of the consumer’s place of residence or elected domicile, if located within Italy, remains unaffected, pursuant to Article 66-bis of the Italian Consumer Code.
